  4. By using our website, registering an account, or subscribing to any of our services, you acknowledge that you have read and understood this Privacy Policy. This policy should be read together with our Terms and Conditions.
  5. Webway may amend this Privacy Policy from time to time. The latest version will always be published on this page, and the "Updated" date above reflects the most recent revision. You agree to check this page regularly for changes.
2. Definitions
  1. "Personal information" means information relating to an identifiable, living natural person, and where applicable, an identifiable, existing juristic person, including but not limited to name, contact details, identification numbers and online identifiers.
  2. "Processing" means any operation performed on personal information, including collection, receipt, recording, organisation, storage, use, disclosure or destruction.
  3. "Client" is the party described as such on any application or service executed between it and Webway.
  4. "Website" means webway.host and any associated Webway subdomains, including the client portal at portal.webway.host.
3. Information we collect
  1. Account and contact information: your name, email address, telephone number, billing address, company name and any other details you provide when registering an account or contacting us.
  2. Domain registrant information: the registrant name, contact details and other particulars required to register, transfer or manage a domain name on your behalf.
  3. Billing and payment information: invoices, transaction records and, where you choose to store a card, the tokenised card details held by our payment processor. Webway does not store your full card number on its own servers.
  4. Support and communications: the contents of support tickets, live chat conversations, emails and other correspondence between you and Webway.
  5. Content you host: data, files, databases and email that you store, transmit or process on the Webway platform.
  6. Technical and usage information: IP address, browser type, device information, pages visited, referring URLs and similar data collected automatically when you use our website or services.
4. How we collect your information
  1. Directly from you: when you register an account, place an order, complete a form, make a payment, or contact our support team.
  2. Automatically: through cookies and similar technologies when you browse our website, as described in the "Cookies and tracking technologies" section below.
  3. From third parties: for example, from domain registries and registrars, or from payment processors confirming the status of a transaction.

  2. Where processing is based on your consent, you may withdraw that consent at any time by contacting us, without affecting the lawfulness of processing carried out before the withdrawal.
7. Cookies and tracking technologies

Our website uses cookies and similar technologies to make the site work, to understand how it is used, and to support our marketing. These include:

  1. Essential cookies that are necessary for the website and client portal to function.
  2. Analytics cookies, including Google Analytics, which help us understand how visitors use our website.
  3. Advertising cookies, including Google Ads and the Meta (Facebook) Pixel, which allow us to measure the effectiveness of our advertising and to show relevant advertising to you.
  4. Live chat, provided by Crisp, which sets cookies to maintain your chat session with our support team.

8. Sharing and disclosure of information

Webway does not sell your personal information. We share personal information only where necessary, including with:

  1. Payment processors (PayFast and Stripe) to process your payments securely. Where you elect to store a card, your card details are stored securely by Stripe and not on Webway's servers.
  2. Domain registries and registrars, who require registrant information to register and maintain domain names. This may include public disclosure through WHOIS or equivalent records, subject to the rules of the relevant top-level domain.
  3. Suppliers and service providers who assist us in operating our platform and delivering our services, under appropriate confidentiality obligations.
  4. Law enforcement, regulators, registrars or other authorities where we are required to do so by law, or where disclosure is necessary to investigate abuse, fraud or a breach of our Terms and Conditions.
  5. A complainant, where Webway is presented with evidence that a domain name or hosted content violates the rights of a third party, in accordance with our Terms and Conditions.
9. International transfers
  1. Webway may host or move data between servers and Internet backbones, both within South Africa and internationally, as necessary to deliver its services. Some of our suppliers and payment processors may also process information outside of your country.
  2. Where personal information is transferred across borders, Webway takes reasonable steps to ensure that it continues to be afforded an adequate level of protection.
10. Data security
  1. Webway has implemented software, hardware and physical security measures in line with good industry practice to ensure the protection of your data. Webway does not warrant that breaches in security will not take place.
  2. The client is responsible for maintaining the confidentiality of their access keys, secret keys and credentials, and for all activities performed using their account.
  3. Webway is not responsible for data loss or unauthorised access resulting from compromised credentials. In the event of a security compromise affecting your account, you consent to Webway accessing your account for the purposes of investigation.
  4. Where a security compromise involving your personal information occurs, Webway will notify you and the relevant regulator where required to do so by law.
11. Data retention
  1. Webway retains personal information for as long as your account is active and for as long as necessary to provide the services, and thereafter as required to comply with our legal, accounting and regulatory obligations.
  2. On cancellation, data hosted on your account may be permanently removed from Webway's servers. Clients are solely responsible for backing up their own content. Any backups made by Webway are made for legal purposes and not for data retention purposes, and will not necessarily be made available to clients on request.
12. Your rights

Subject to applicable law, you have the right to:

  1. Request access to the personal information Webway holds about you.
  2. Request that inaccurate or incomplete personal information be corrected or updated.
  3. Request that your personal information be deleted, where Webway is not required to retain it.
  4. Object to the processing of your personal information in certain circumstances.
  5. Withdraw your consent to processing that is based on consent.
  6. Lodge a complaint with the relevant data protection authority.

13. Direct marketing
  1. Webway may send you marketing communications about its products, services and offers where you have consented or where permitted by law. Every marketing email includes an option to unsubscribe.
  2. You may opt out of marketing communications at any time by using the unsubscribe link, adjusting your preferences in the client portal, or contacting us at support@webway.host. Opting out of marketing does not affect service-related communications, which are necessary to provide your services.
14. Children
  1. Webway's services are intended for use by persons who are able to enter into a legally binding contract. We do not knowingly collect personal information from children without the consent of a parent or guardian. If you believe we have collected such information, please contact us so that we can remove it.
